GENERAL TERMS AND CONDITIONS OF SALE
Between the municipality of Bayonne, represented by its current mayor, Mr. Jean-René Etchegaray, duly authorized for the purposes herein, hereinafter referred to as “the Seller”,
on the one hand,
And the natural or legal person purchasing products or services, hereinafter referred to as “the Buyer”,
on the other hand.
Article 1: Purpose and General Provisions of Online Sale of Tickets to the Bonnat-Helleu Museum
These General Terms and Conditions of Sale (hereinafter “GTC”) define the rights and obligations of the parties with respect to the online sale of products or services offered by the Seller. They apply to all sales of products or services carried out through this website: mbh.bayonne.fr. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable GTC are those in force at the date of payment of the order.
The Seller ensures that acceptance of these terms is clear and unreserved by requiring a checkbox and a validation click. The Buyer declares having read all of these General Terms and Conditions of Sale and accepts them without restriction or reservation. The Buyer acknowledges that they have received the necessary advice and information to ensure that the offer is suitable for their needs. The Buyer declares that they are legally capable of entering into a contract under French law or duly authorized to represent the natural or legal person on whose behalf they act. Unless proven otherwise, the information recorded by the Seller constitutes evidence of all transactions.
Article 2: Tickets
One type of access ticket may be ordered via the online ticketing system or at the Bonnat-Helleu Museum reception desk.
Tickets (thermal or e-tickets)
Individual ticketing (< 10 persons)
All access details are specified on the ticket: location, date, time, and nature of the service.
Group ticketing (> 10 persons)
For groups of more than 10 people, visitors are considered to be a group.
Any request for a group visit, whether a guided tour or a self-guided visit, must go through the ticketing department to obtain a visit slot.
For self-guided group visits with an external guide to the Bonnat-Helleu Museum, a visit fee will be charged. Group visit capacities are limited to 25 persons (30 for school groups), including accompanying adults. Any booking constitutes acceptance of the group visit conditions, available upon request or on the website.
Maximum number of tickets:
The total number of tickets that the Buyer may order cannot exceed the number of places set by the Seller across all categories. Unless otherwise indicated at the time of ordering, this number is 9 per service.
The Buyer undertakes not to use any circumvention method to acquire more tickets than the limit set by the Seller (e.g., placing multiple successive orders). If this occurs, the Seller may take any measures against the Buyer, including canceling the order to prevent further violations of these General Terms and Conditions of Sale.

Availability:
Reservations are made in real time. Our server informs the Buyer in real time about ticket availability at the time of the order. If the tickets do not meet their needs, the Buyer may remove items from the cart before confirming the purchase. In the event of a fully booked service or time slot, no waiting list can be established.
Article 3: Prices
The prices of products sold through the website are indicated in euros, all taxes included, and are precisely specified on the product description pages. They are also indicated in euros, all taxes included, on the product order page, excluding specific shipping costs. Any telecommunication costs necessary to access the Seller’s website are the responsibility of the Buyer, as well as any delivery fees, if applicable.
The Seller reserves the right to modify its prices at any time. Products and services will be invoiced based on the rates in effect at the time the orders are recorded.
Different types of rates may be offered depending on the services. A valid proof of eligibility will be requested for any person benefiting from a reduced or free rate.
In the event of an erroneous purchase, the Seller reserves the right to refuse entry and to invite the Buyer or the holder of the access ticket to purchase a ticket at the correct rate, without any claim for reimbursement being granted.
Tickets and other access rights may not be resold to a third party. Entry tickets and membership cards are nominative and may be transferred to a third party.
Article 4: Conclusion of the Online Contract
The Buyer must follow a series of steps specific to each product offered by the Seller to place an order. However, the following steps are systematic:

Information on the essential characteristics of the Product;

Choice of the Product, including options if applicable, and provision of essential Buyer information (identification, address, etc.);

Acceptance of these General Terms and Conditions of Sale;

Verification of the order details and, if necessary, correction of errors;

Following instructions for payment and payment of the products.
For the proper execution of the order, and in accordance with Article 1316-1 of the French Civil Code, the Buyer undertakes to provide truthful identification information.
Article 5: Order Validation and Obtaining Access Tickets
The order of tickets or membership cards is only definitively confirmed and binds the Seller upon receipt of the email confirming that the order has been successfully validated.
Consequently, the Buyer must check their email, including the spam/junk folder.

Entry Tickets
Tickets purchased online cannot be collected at the Bonnat-Helleu Museum reception.
A link to the reserved tickets is included directly in the order confirmation email.
Tickets are also available for download from the Buyer’s account under “My Orders,” immediately after payment and until the end date of the service.
The Buyer may access the Bonnat-Helleu Museum only with the ticket(s) containing the visible QR CODE, for the specified date and time.
For printing PDF e-tickets, it is the responsibility of the Buyer (or ticket holder) to ensure they have appropriate equipment.
To be valid, the e-ticket must be printed in portrait or landscape format on a blank A4 sheet, front and back. A good print quality is required; partially printed, soiled, damaged, or illegible e-tickets will not be accepted and will be considered invalid. The QR CODE must be readable. Each purchased place corresponds to one e-ticket; the ticket holder undertakes to retain it throughout the visit.
E-tickets may also be presented on a mobile phone or tablet.
The Buyer (or ticket holder) must ensure that their device is fully charged and that the screen brightness is maximized for optimal QR CODE readability.
For smooth access, the Seller recommends downloading the ticket prior to the visit to avoid login issues (forgotten password, Wi-Fi problems, etc.).
Anomalies
The Seller declines any liability for anomalies occurring during the ordering process, ticket processing, or printing, insofar as they were not intentionally caused or the result of negligence, including in cases of loss, theft, or illicit use of the access ticket.
No duplicate, certificate, or reissued access ticket of any kind will be provided to the Buyer, other than the original access ticket printable by the Buyer.
Article 6: Access to the Bonnat-Helleu Museum
All persons entering the Bonnat-Helleu Museum (excluding the shop, café, and courtyard) must hold a valid access ticket.
A valid access right consists of:

The ticket / e-ticket (digital format) issued by the ticketing system (counter / kiosk / website / phone), generated by the ticketing software and containing a valid QR CODE;

The membership card for the Friends of the Bonnat-Helleu Museum;

Certain permanent or temporary passes issued by the Seller or any entity authorized by the Seller.
Validity is defined in advance and indicated on the access right. A valid identity document may be requested by reception or security staff.
For timed services, it is strongly recommended to arrive at least 15 minutes before the start of the activity or visit.
The Seller reserves the right to refuse access to any visitor who does not comply with these conditions (invalid ticket, late arrival, etc.).
The Buyer cannot claim any reimbursement or compensation from the Seller.
QR Code:
Tickets and membership cards are equipped with a unique QR CODE. Validity is verified and recorded at the entrance using QR CODE scanners.
Unless a ticket is configured for multiple services or dates, entry with the same ticket multiple times is not allowed.
Only the first person presenting the ticket will be admitted and may benefit from the purchased service. This person is presumed to be the legitimate ticket holder.
It is therefore prohibited to reproduce, duplicate, or counterfeit the ticket in any manner, or to make it available for such purposes. Tickets must be kept securely.
The official sales channel should be used exclusively for purchasing tickets, and tickets from unknown sources should never be accepted. They may be copies.
The Seller reserves the right to refuse entry when multiple prints, reproductions, copies, or imitations of a ticket are in circulation, and access has already been granted to a holder of a legitimate print, copy, or imitation.
The Seller is not obliged to verify the identity of the person presenting the ticket to ensure they are the Buyer, nor to verify ticket authenticity where the copy or imitation cannot be definitively identified during entry control.
If a ticket holder is refused entry for this reason, no refund of the price paid is due.
Article 7: Products and Services
The essential characteristics of products, services, and their respective prices are made available to the Buyer on the dedicated website. This contractual information is presented in detail in French. In accordance with French law, a summary and confirmation are provided during order validation. Unless otherwise specified, the rights granted under these Terms and Conditions apply solely to the natural or legal person placing the order (or the person holding the provided email address).
Article 8: Retention of Title Clause
Products remain the property of the Seller until full payment of the price.
Article 9: Payment
The Buyer may make payment only by bank card. Cards issued by banks outside France must be international cards (Mastercard or Visa).
Secure online payment by card is handled by the Seller’s payment service provider. All transmitted information is encrypted and cannot be read during transmission. Once payment is initiated by the Buyer, the transaction is immediately debited following verification of the information.
In accordance with Article L.132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable. By providing banking information during the sale, the Buyer authorizes the Seller to debit the card for the amount indicated. The Buyer confirms that they are the legal cardholder and legally entitled to use it. In case of error or inability to debit the card, the sale is automatically voided and the order canceled.
Article 10: Withdrawal Period
In accordance with the French Consumer Code, notably Articles L.121-20 et seq., the Buyer does not have a right of withdrawal. Tickets are valid only for the service for which they were sold. No duplicates can be issued, including in cases of loss or theft. Tickets are non-refundable, non-exchangeable, except in cases of cancellation or rescheduling of the service as described below.
Cancellation / Rescheduling:
In the event of cancellation or rescheduling of a service, the Seller will make best efforts to inform the Buyer, primarily via the website, or by email or telephone according to the information provided at the time of the order.
Refund procedures for tickets will be communicated to Buyers and handled directly by the Seller.
The Seller undertakes to refund the Visitor the total price of the ticket(s) including VAT (face value). No additional fees of any kind (shipping, insurance, travel, etc.) will be refunded or covered by the Seller.
Refunds are granted exclusively to the purchaser of the tickets upon return of the ticket(s).
Article 11: Guarantees
The Buyer must verify at the time of purchase the number of tickets, names, date, location, time, and price indicated on the ticket(s).
No subsequent claims will be considered.
The Seller declines all liability for damage of any kind to personal belongings, objects, or equipment brought by visitors that have not been deposited in designated areas.
Buyers / ticket holders are responsible for any direct or indirect damage they may cause during their presence at the Bonnat-Helleu Museum.
All ticket holders must comply with the museum regulations.
The Seller reserves the right to refuse entry to minors under 15 years not accompanied by an adult and not holding parental authorization.
For any question or complaint, the Buyer / ticket holder may contact the ticketing department.
Postal correspondence regarding complaints must be addressed to:

Article 12: Complaints
The Buyer may submit any complaint by contacting the Seller at: musee-bonnat-helleu@bayonne.fr. A procedure will be communicated regarding their request, or a Seller representative will contact them directly.
Article 13: Intellectual Property Rights
Trademarks, domain names, products, software, images, videos, texts, or any other intellectual property remain the exclusive property of the Seller. No intellectual property rights are transferred through these GTC.
Any total or partial reproduction, modification, or use of these assets for any purpose is strictly prohibited.
In accordance with the provisions of the Intellectual Property Code and international treaties, any reproduction, disclosure, distribution, representation, translation, dissemination, modification, transcription, partial or total, on any medium and by any process for non-private use is prohibited without the prior express authorization of the Seller.
Any violation constitutes infringement and may engage the civil and criminal liability of the perpetrator. Law No. 98-536 of July 1, 1998, on databases, grants no exception.
Article 14: Force Majeure
The Seller’s obligations under these terms are suspended in the event of force majeure or unforeseen circumstances preventing performance, such as (without limitation) adverse weather, strikes, fire, water damage, illness of a staff member, etc.
The Seller will notify the Buyer as soon as possible. The Seller shall not be held liable for changes in program or service schedules.
Article 15: Nullity and Contract Modification
If any provision of this contract is declared void, this shall not affect the validity of the remaining provisions, which shall remain in force.
Any contractual modification is valid only if agreed in writing and signed by both parties.
Article 16: Protection of Personal Data
When placing an order, the Seller may collect certain personal data from the Buyer to manage the order.
These data are stored in the Buyer’s account and used for order processing, follow-up, and communication (service cancellation, rescheduling, requests for supporting documents, visit instructions, etc.).
The Seller may, in accordance with Article L.34-5 of the French Postal and Electronic Communications Code, send offers for services similar to those already ordered. The visitor may object to the use of their personal data by sending an email to musee-bonnat-helleu@bayonne.fr.
If consent is given by checking the relevant box, the visitor authorizes the museum to send newsletters by email. The visitor may withdraw consent at any time by emailing musee-bonnat-helleu@bayonne.fr or using the unsubscribe link in the newsletter.
The Seller may collect website navigation data using cookies. Cookies are files stored on the visitor’s device, allowing collection of navigation information (pages viewed, date/time of access, etc.) for improved navigation. These data do not identify the visitor personally.
In accordance with the French Data Protection Act of January 6, 1978, and the EU General Data Protection Regulation (GDPR) effective May 25, 2018, the Buyer has rights of inquiry, access, modification, opposition, and rectification. Requests must be signed, include a copy of a signed ID, and specify the address for the response, which will be sent within 2 months.
Article 17: Applicable Law
All clauses in these General Terms and Conditions of Sale, as well as all related purchase and sale operations, shall be governed by French law.
